Wheelchair accessible taxis and hire vehicles: grandfathering arrangements for space requirements in older wheelchair accessible vehicles ending soon

Published

On 1 November 2017 the Point to Point Transport (Taxis and Hire Vehicles) Regulation 2017 introduced dimension requirements for wheelchair accessible taxis and hire vehicles with an exemption applying to some vehicles until 1 November 2019.

From 1 November 2019 all wheelchair accessible taxis (WAT) and wheelchair accessible hire vehicles in NSW must ensure the space where a wheelchair is carried inside a vehicle is at least 1,300mm long, 800mm wide and 1,500mm high, with no intrusions except for adjustable restraint devices. Authorised taxi and booking service providers must ensure that all wheelchair accessible vehicles in their fleet will be compliant with these requirements by this date.

Vehicles which do not comply with the dimension requirements from 1 November 2019 must not be used to provide a passenger service of any kind.  To use the vehicle lawfully to provide a passenger service after this date the vehicle must be modified so that it is no longer wheelchair accessible. If the vehicle is to be used as a taxi then an appropriate taxi licence (not a WAT licence) must be held.
